Fact Checked By: Adam Zdroik

West Virginia passed a law to legalize and regulate sports betting in 2018 prior to the repeal of PASPA. Once that happened at a federal level, sports betting was immediately legal in the state with the Lottery Commission overseeing regulations and licensing in regards to in-person and online betting.

More specifically, each of the five casinos in the state were allowed to hold licenses and operate three individually-branded online sites. With the maximum number of online sportsbooks set at 15, the number will continue to grow until that number is reached. Betly and BetMGM were the most recent sportsbooks to join the state, securing partnerships in early 2020.

Daily Fantasy Sports and horse racing betting are also allowed in the state. Fantasy sports were deemed a game of skill and in turn, is considered legal by West Virginia, though there is no formal legislation for them.
